This site is owned and operated by TrappCall ("we", "us", "our" , "TrappCall" or “TrappCall Phone Services”). TrappCall provides its services to you ("Customer", "you", "end user", “client” or “subscriber”) subject to the following conditions.
If you visit or shop at our website, other affiliated websites, on the phone with TrappCall Customer Service Automated IVR or on the phone with TrappCall Live Customer Service Representative, you affirmatively accept the following conditions. Continued use of the site, continued use of the TrappCall Automated IVR as well as continued service requests to our live Customer Service Representative via the TrappCall Customer Service Telephone number constitutes the affirmative agreement to these terms and conditions.
TrappCall reserves the right to change the terms, conditions and notices under which the TrappCall sites and services are offered, including but not limited to the charges associated with the use of the TrappCall sites and services.
1.1. Electronic Communication
When you visit TrappCall websites or send Email to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by Email or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
1.2. Telephone Communication
When you call the TrappCall Customer Service Telephone Number and communicate with a TrappCall Customer Service Representative or, accept a call from a TrappCall Customer Service Representative and thereafter communicate with the TrappCall representative on that telephone call, you are communicating with us via Telephone. You consent to communicate with us by Telephone. We will communicate with you by Telephone or by leaving you voice messages on your phones answering service. You agree that all agreement, notices, disclosures and other communications that we provide to you during the telephone conversation or by a voice message left on your telephones answering service satisfy any legal requirements that such communication be in writing.
2.1. All content on this site, such as text, graphics, logos, button icons, images, data compilations and software, is the property of TrappCall and is protected by international copyright laws. The compilation of all content on this site is the exclusive property of TrappCall and is protected by international copyright laws. All software used on this site is the property of TrappCall and is protected by international copyright laws.
3. Services & Conditions
3.1. TrappCall shall not be held liable for any delay or failure to provide service(s) at any time. In no event shall TrappCall, its officers, Directors, Employees, Shareholders, Affiliates, Agents or Providers who furnishes services to customer in connection with this agreement or the service be liable for any direct, incident, indirect, special, punitive, exemplary or consequential damages, including but not limited to loss of data, lost of revenue, profits or anticipated profits, or damages arising out of or in connection to the use or inability to use the service. The limitations set forth herein apply to the claimed founded in Breach of Contract, Breach of Warranty, Product Liability, Tort and any and all other liability and apply whether or not TrappCall was informed of the likelihood of any particular type of damage.
3.2. TrappCall makes no warranties of any kind, written or implied, to the service in which it provides.
3.3. TrappCall provides prepaid services only. You must keep a positive balance to retain services with TrappCall. You must pay all negative balances immediately. Customer agrees to keep a positive balance in customer's account at all times and agrees to pay the rate in which the customer signed up for to USA, Canadian and other International destinations. Customer agrees to pay any and all charges that customer incurs while using TrappCall's service.
3.4. TrappCall services are not intended for use as a primary telephone source for business or residential users.
3.5a. TrappCall unlimited local Service (US & CA) packages are intended for residential use only. TrappCall unlimited local Service packages include the use of 2 simultaneous channels and include a maximum of 4000 inbound minutes per month.
3.5b. TrappCall retail accounts are limited to a maximum of 10 simultaneous inbound and outbound calls. These limits may be increased per request at the discretion of TrappCall.
3.6. TrappCall does not allow calls originating from Payphones to toll free numbers on its network.
3.7. Any call placed to Directory Assistance (411, 1-XXX-555-1212) including Toll Free numbers (1-800-555-1212) will incur a $0.99 per call charge as the call will be routed to our Carrier(s) National Directory Assistance call center.
3.8. At TrappCall's sole discretion, you may incur a port away fee for any Service number(s) leaving TrappCall's network as this is a pass-through charge from TrappCall's underlying carrier(s).
3.9. TrappCall service account automatically goes dormant after 3 months of no use and will be automatically closed once the account balance goes below $1.00. TrappCall will not notify subscriber of automatically closed accounts.
3.10. All calls placed through TrappCall's network are billed at 60 second increments unless otherwise stated.
3.11. Use of TrappCall's services for telemarketing, broadcast faxing, delivery of unauthorized or unsolicited advertising, promotional materials or solicitations is strictly prohibited. Failure to abide by these terms will result in immediate account termination.
3.12. Customer agrees to the exclusive jurisdiction of the courts of Denver County in the state of Colorado in the United States of America for any and all legal matters.
3.13. Violation of any state laws, federal laws, city laws, provincial laws or laws for any other competent jurisdiction may result in immediate account termination and/or disconnection of the offending service.
3.14. TrappCall reserves the right to terminate service at any time with or without notice; especially if Customer is found to be in violation of TrappCall's Terms & Conditions. You agree that TrappCall shall not be liable to you or to any third party for any modification, suspension or discontinuance of service.
3.15. Due to the nature of this industry, high payment fraud rate and telephone calling impersonation rate, TrappCall indubitably reserves the right to request the following documentation for verification purposes; A copy of the credit card used to establish the account (if applicable), valid photo identification such as a Passport, Drivers License or other Government issued identification, bill or statement bearing current name and address. TrappCall reserves the right to withhold disclosing account information including but not limited call history, payment history, address, email, telephone number(s) and account balance in the event that account holder is not able to provide identification that clearly authenticates account holder to the TrappCall account in question. TrappCall also reserves the right to suspend or terminate services of the account in question, in the event that the account holder is not able to, or refuses to provide proper government identification that clearly authenticates the account holder to the TrappCall account in question.
3.16. TrappCall will provide subscriber with a legal receipt for all payments made towards account(s). On request, TrappCall will provide you with account usage information such a fees, calls and other charges by way of supporting / supplementary documentation only.
3.17. You are solely liable for any transmissions sent through the TrappCall service(s). TrappCall has no control over the content of any transmission nor will be liable for such content. TrappCall has no control over how you will use the service nor will be liable for such usage. You shall not use the service(s) to create or distribute any images, sounds, messages, or other materials which are obscene, harassing, racist, malicious, fraudulent, infringing or libelous, nor use the service(s) for any activity that may be considered or are unethical, immoral, abusive of any third party's rights, or illegal. Furthermore, you will abide by all rules, regulations, procedures, and policies of TrappCall and any policies of the networks connected to the service(s). You agree to abide by all applicable local, federal, provincial, state, national, foreign, and international laws and regulations and is solely responsible for all acts or omissions that occur under the Subscriber account, including the content of your transmissions through the service(s).
3.18. Subscriber will not assign, transfer, sell or otherwise dispose of, for valuable consideration or otherwise, any TrappCall service, or any aspect thereof.
3.19. Subscriber agrees that subscriber will not receive call detail statements unless requested in writing via email or regular mail. Subscriber also agrees that it is the subscriber's responsibility to review all call detail statements for accuracy using the call detail statements received or via the Customer Web Console.
3.20. Subscriber agrees to notify TrappCall via email or telephone within 30 days of the account's monthly account renewal date of any billing discrepancies. Subscriber agrees that all discrepancies submitted after the 30 day period will not be considered or reviewed.
3.21. Subscriber agrees that Collect Calls will be received from the City for which the TrappCall Collect Call number is issued and to use this number to receive Collect Calls from that city only.
3.22. Subscriber agrees that any calls received from a City that is different from the original city that the Collect Call service was established for, the subscriber will be responsible for the long distance Collect Call charges and that these charges will be higher and at a rate of at least eighty cents per minute plus connection charges.
3.23. Subscriber agrees to notify TrappCall via email or telephone if and when the calls are no longer being received from the original city for which the Collect Call service was established.
3.24. Subscriber agrees that though TrappCall will attempt to send low balance notifications to the subscriber via email, it is the subscribers responsibility to monitor subscribers account balance at all times. Subscriber agrees that TrappCall will not be held responsible for subscriber not receiving calls due to a low balance on the subscribers TrappCall account.
3.25. Subscriber agrees that even though subscriber is establishing a Pre-Paid collect Call Service Account, Long distance collect calls if received will be billed separately and can potentially exceed the subscribers existing available Pre-Paid balance which could result in negative Pre-Paid account balance after the long distance charges are applied to the subscribers account. Subscriber also agrees that collect calls exceeding 60 seconds in duration will be treated as an accepted collect call and will be billed/charged as an accepted collect call.
3.26. Subscriber agrees that a non collect call account is to be used for receiving non collects call only. Subscriber agrees that if a non collect call account is used to accept a collect call, then this call will be billed at a rate of $0.12 per minute plus a connection fee of $1.50 and a monthly service fee of $15.00.
4. Refund Policy
4.1. We offer refunds on remaining pre-paid balance upon request for all payments made within 60 days. We do not offer refunds for monthly subscriptions such as Local Phone Numbers, Toll Free numbers or Collect Call Telephoe Numbers. There will be no refunds for one-time/setup fees/registration fees. Refunded amounts will not include any bonus/promotional credits that have been applied to customers account.
4.2 Refunds will be issued via the same means that payment is made to the account. If payment was made by direct bank deposit, online bill payment or cheque, the refund will be isued in the form of a cheque, in the name and address on the account. If payment was made by several different methods the refund will be made via the form/method of the most recent (last) payment(s) up to a maximum of each payment amount.
4.3 All refunds are subject to a $5 refund fee and take 30 days to be processed.
4.4 Refunds will be issued for accounts having a closing balance greater than $10.00. Accounts with a closing balance of $10.00 and below will not receive a refund and funds will remain on subscribers account for 6 months as a credit for future use. Sunscriber may donate closing account balance to another subscribers account.
4.5 Monthly recurring fees that are paid for the current month period are non refundable.
4.6 Monies charged for calls made or received are non refundable.
5. Site Policies, Modification & Severability
5.1. We reserve the right to make changes to our site, policies, and these Terms & Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
6. General Complaints
6.1. Please send reports of activity in violation of these Terms & Conditions to email@example.com. TrappCall will reasonably investigate incidents involving such violations. TrappCall may involve and will cooperate with law enforcement officials if any criminal activity is suspected. Violations may involve criminal and civil liability.
7. Disposal, Transfer or Assignment of Service
You will not assign, transfer, sell or otherwise dispose of, for valuable consideration or otherwise, any TrappCall service, or any aspect thereof.

911 - Emergency call service typically used for delivering emergency calls to a public safety access point.

e911 Terms & Conditions
Due to recent pursuant FCC rulings and regulations, All sunscribers who are using TrappCall services as their primary residential or business telephone carrier must activate 911 Emergency Services on at least one of their Phone Numbers.
Enhanced 911, the portion of our 911 service which delivers physical address information to your local PSAP is not guaranteed. It is possible that your physical address information may not be passed to the PSAP dispatcher. On occasions such as this you will be required to give the dispatcher the location of your emergency in order to receive emergency service assistance.
Enhanced 911 service is not available to every location within the United States and Canada at this time. For locations e911 is not currently available; You will be required to announce the location of your emergency to the PSAP dispatcher.
Due to the nature and instability of VoIP networks, we cannot and do not guarantee your emergency call will complete. Loss of power, Internet access and or several other conditions may cause 911 to be inoperable. We have no control over those types of situations therefore are not held liable. TrappCall will do everything within their power to prevent service outages within it's network.
In order for e911 address information to be passed to your local PSAP dispatcher, you must set your outbound caller ID value to the specific Phone Number you are purchasing e911 service for. Therefore, by agreeing to these Terms & Conditions you the customer agree to set the outbound Caller ID number to the Phone Number you have enabled e911 services for when making an outbound 911 emergency call. Failure to set the correct caller ID value will result in a non-refundable $125 surcharge per 911 call.
We have added an extension to our network which all TrappCall users may call to test their Caller ID value. At any time, you may test your outbound caller ID value by dialing '111' through our network.
By using TrappCall's Enhanced 911 service, Subscriber agrees that TrappCall, it's contractors, executives, members, subscribers, agents, employees, carriers, 911 providers, and any anyone else associated with TrappCall is not held liable for emergency calls failing, even if it is determined that it is the fault of TrappCall or it's associates. Customer further agrees that they will notify their Customers, contractors, agents, employees, associates, shareholders, partners, and anyone who may use the TrappCall 911 service of our limitations and make Customers agree to not hold TrappCall or Customer liable.
Subscriber will be charged a regulatory recovery fee of $1.49 per month for each Phone Number submitted to the e911 database. This fee is non-refundable. Failure to enable e911 service will result in a non-refundable $125 surcharge per 911 call.
